1. Acceptance of These Terms

Welcome to Real Estate Marketing. By accessing, registering with, using, or submitting information to this website, you agree to be bound by these Terms & Conditions and all applicable laws and regulations.

If you do not agree with these Terms & Conditions, you should not use the website or its services.

2. About Real Estate Marketing

Real Estate Marketing is an online real estate marketing and property listing platform that allows verified agents, developers, property professionals, and authorized property listers to present real estate properties and projects to potential buyers.

Real Estate Marketing primarily provides the online platform, property listing services, and related website features. The platform is not automatically a party to any sale, reservation, lease, or other transaction between a buyer and a property lister.

3. Agent Verification and Website Activation

Agents, developers, brokers, and other authorized property listers who wish to access the property listing features must undergo the verification and activation process required by Real Estate Marketing.

The current website activation and verification fee is:

₱10,000 per year

This annual fee provides an eligible agent, developer, broker, or authorized property lister with access to the website's applicable listing features, including the ability to submit and manage property or project listings, subject to verification and platform rules.

Payment of the annual fee does not automatically guarantee approval. Real Estate Marketing may review submitted information and may approve, reject, suspend, or restrict an account or listing when necessary.

4. Annual Renewal

The website activation and verification is valid for one (1) year unless otherwise stated by Real Estate Marketing.

Continued access to applicable agent and property listing features may require renewal of the annual ₱10,000 activation and verification fee.

5. Property Listings

Agents, developers, brokers, and property listers are solely responsible for the accuracy, completeness, legality, and authenticity of the information they submit.

This includes, but is not limited to:

  • Property descriptions
  • Property prices
  • Property location
  • Property images and videos
  • Availability
  • Project information
  • Ownership or authority to market the property
  • Reservation requirements
  • Payment instructions provided to buyers

A property lister must not publish false, misleading, fraudulent, unauthorized, or deceptive information.

6. Meaning of Verification

Verification by Real Estate Marketing means that an agent, developer, broker, or property lister has undergone the verification process established by the platform.

Verification does not constitute a guarantee, certification, endorsement, warranty, or promise by Real Estate Marketing regarding the financial capacity, business conduct, ownership, authority, performance, or future actions of a verified agent, developer, broker, or property lister.

7. Reservation Fees and Property Transactions

Real Estate Marketing does not collect, receive, hold, or process reservation fees paid directly by buyers to agents, developers, brokers, or property listers, unless a separate written arrangement expressly provides otherwise.

When a buyer decides to reserve a property, the reservation transaction is directly between the buyer and the agent, developer, broker, or property lister responsible for that property listing.

The agent, developer, broker, or property lister is solely responsible for providing the buyer with accurate payment instructions, official receipts or documentation where applicable, reservation terms, refund policies, cancellation policies, and other transaction requirements.

Real Estate Marketing does not collect the full purchase price of properties merely because those properties are listed on the website.

8. Buyer Responsibility and Due Diligence

Buyers are responsible for conducting their own due diligence before making any reservation payment or entering into any property transaction.

Buyers should independently verify the identity and authority of the agent or developer, property ownership or project authority, property documents, payment instructions, reservation terms, and other relevant information before sending money.

9. Fraud, Misrepresentation, and Unauthorized Transactions

Real Estate Marketing does not guarantee that every property, listing, agent, developer, broker, or property lister is free from fraud, misrepresentation, unauthorized activity, or other unlawful conduct.

To the extent permitted by applicable law, Real Estate Marketing shall not be responsible for losses arising from fraudulent, deceptive, unauthorized, or misleading acts committed by an agent, developer, broker, or property lister in connection with a property transaction.

Any claim involving a reservation payment, property sale, misrepresentation, failure to deliver, unauthorized collection, refund, cancellation, or similar transaction issue should primarily be directed to the agent, developer, broker, or property lister involved in that transaction.

Nothing in these Terms is intended to exclude any liability or responsibility that cannot legally be excluded under applicable law.

10. Real Estate Marketing's Role

Real Estate Marketing provides an online platform for marketing and presenting real estate listings.

Unless expressly stated otherwise in writing, Real Estate Marketing is not the seller, developer, owner, broker, agent, lender, escrow service, payment processor, or contracting party in the property transaction between a buyer and a property lister.

11. Suspension or Removal of Listings

Real Estate Marketing reserves the right to review, remove, restrict, suspend, or deactivate any account or property listing that violates these Terms, applicable laws, platform policies, or reasonable safety and integrity standards.

Real Estate Marketing may also take action when it receives credible information concerning suspected fraud, misleading information, unauthorized property listings, or other potentially harmful activity.

12. Prohibited Activities

Users and property listers must not use the website to:

  • Publish fraudulent or misleading property information
  • Impersonate another person or business
  • List a property without proper authority
  • Provide false payment or reservation instructions
  • Attempt to defraud or deceive buyers
  • Upload unlawful or infringing content
  • Abuse or interfere with website functionality
  • Use the platform for unlawful purposes

13. Payments to Real Estate Marketing

The primary fee collected by Real Estate Marketing from eligible agents, developers, brokers, or property listers is the annual Agent Verification and Website Listing Activation Fee of ₱10,000 per year, subject to the applicable verification and activation requirements.

This fee is separate from any reservation fee, purchase price, commission, or other amount that may be agreed upon between a buyer and a property lister.

14. No Guarantee of Property Sale

Payment of the annual activation and verification fee does not guarantee that an agent, developer, broker, or property lister will receive inquiries, reservations, sales, commissions, or any particular business result.

15. Intellectual Property

Website content, branding, logos, designs, software, graphics, and other materials belonging to Real Estate Marketing may not be copied, reproduced, modified, distributed, or commercially used without appropriate authorization.

Property listers remain responsible for ensuring that they have the necessary rights and permissions to upload photographs, videos, descriptions, logos, documents, and other content submitted to the platform.

16. Privacy

Use of the website is also subject to our Privacy Policy, which explains how personal information may be collected, used, stored, and protected.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Real Estate Marketing shall not be liable for indirect, incidental, special, consequential, or other losses arising from transactions between buyers and agents, developers, brokers, or property listers.

This includes, where legally permissible, losses related to reservation payments, property purchases, representations made by property listers, delays, cancellations, refunds, or failure to complete a property transaction.

This limitation does not apply to liability that cannot legally be excluded or limited under applicable law.

18. Changes to These Terms

Real Estate Marketing may update or modify these Terms & Conditions from time to time. Updated Terms will be posted on this page with a revised effective or updated date.

Continued use of the website after changes are posted constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
